BASQUE INCOMING TRAVEL, S.A. -BITRAVEL is committed to guaranteeing the services outlined on this web site in accordance with the Law of Package Travel 21/1995, of July 6 (B.O.E 7-7-1995); the Law on General Contract Conditions 7/1998, of April 13 (14-4-98); and the General Law for the Protection of Consumer and Users 26/1984, of July 19 (B.O.E 24-7-84); and all other applicable provisions.




Price  up
The price of the travel package includes - Everything expressly outlined in the travel package and service contract, as well as fees and indirect taxes where applicable (VAT, IGC).

The price of the travel package does not include - Visas, airport and /or arrival and departure taxes, vaccination certificates, extras such as coffee, liquor, mineral water, special food regimens unless expressly agreed to in the contract, laundry, optional hotel services, and in general any other service that is not expressly outlined in the section "Travel includes," or is not specifically described in the offer.

Purchase of services  up
Purchase will only be considered completed when the total amount for the service has been paid. It is not possible to make a reservation without complete payment, or to pay in instalments, unless previously agreed to between the customer and Bitravel. Services are subject to the expiration period established in the offer.

Administrative costs  up
In the case of specially designed travel for groups, Bitravel may request a deposit (never to exceed 10% of the estimate) prior to presenting the offer in order to cover administrative costs. If the offer is later accepted, this amount will be deducted from the total.

Cancellation by the client  up
The client can at any time cancel the requested or contracted services with the right to a refund for the paid amount, whether it be the total price or the aforementioned deposit. The following cancellation costs will apply:

  • In the case of miscellaneous services, the administrative costs and cancellation costs if applicable.

  • In the case of tourist packages, the cancellation costs.

Administrative Costs are understood to be 10% of the total cost of travel

Cancellation Costs are understood to be those defined by the Law:

  • 5% of the total cost of travel if cancellation takes place more than 10 days but fewer than 15 days prior to start of travel.

  • 15% for cancellations less than 10 days but more than 3 days from that date.

  • 25% in the 48 hours prior to departure.

  • 100% if the client does not cancel prior to departure. In this case the client will not have the right to a refund, unless there are extenuating circumstances.

Insurance  up
Optional insurance is available.

Transfer of travel  up
The package travel customer can transfer his or her reservation to a third party by requesting it in writing at least 15 days prior to the start of travel.

The transferee will have to fulfil the same requirements as the transferor, generally required for the package travel, and both will be responsible to the travel agency for payment travel price and any reasonable additional costs incurred by the transfer.

Changes  up
In the hypothetical case that 5 days prior to start of travel Bitravel sees itself obliged to modify in a significant manner any essential element of the contract, including the price, it must immediately place this at the knowledge of the customer. In such cases, and unless the parties agree otherwise, the customer can choose between:

  • Cancelling the contract. In this case the client will immediately be reimbursed for all paid amounts, or will be provided with another travel package of equal or higher value or higher, if the organizer and the retailer can provide one. In the case of a lower value travel package, Bitravel will reimburse the customer the difference in price.

  • Accepting a modification of the contract in which the established changes and impact on the price are specified.

The customer should communicate his or her decision to Bitravel within three days after being notified of the modification. If the customer does not notify Bitravel of his or her decision as outlined above, it will be understood that he or she opts for the modification of the contract without penalty.

In the hypothetical case that after travel commences, the organizer does not provide or will be unable to provide an important part of the services agreed to in the contract, the organizer will adopt satisfactory measures for the continuation of travel, with no additional cost to the customer, and if applicable will credit the customer the difference in price between the agreed to services and those provided. If the customer continues travel with the measures provided by the organizer, this will be tacit acceptance of these changes.

If the measures adopted by the organizer are unviable or are not accepted by the customer on reasonable grounds, the organizer will arrange for transportation equivalent to that used in the travel to return to the departure point or any other agreed to point, with no additional cost and with no effect on any applicable compensation.

The organizer will in no case be responsible for any costs that are not included in the travel package contract, such as transportation from the passenger's place of origin to the place of travel departure, or vice versa, hotel reservations for days prior to or after travel, etc.

Cancellation by Bitravel  up
In the hypothetical case that Bitravel cancel travel five days before the departure date, it will be responsible for the payment of compensation to the customer for breaking the contract. Compensation will be 10% of the travel price if the cancellation is between fiver and three days prior to travel, and 25% of the travel price if the contract is broken 48 hours prior to the departure date.

There will be no obligation to provide compensation in the following cases:
  • When the cancellation is due to the number of people registered for the package travel are fewer than required, and this is communicated in writing to the customer prior to the deadline set in the contract.

  • When the cancellation of travel is due to outside forces, understanding these to be atypical and unpredictable, and whose consequences were unavoidable, despite having acted with the necessary diligence.

Special rates for children  up
For those travelling with children, BITRAVEL has determined that:

  • Children from ages 0-3. With regards to Bitravel they will travel free. Payment should be provided directly to the hotel and restaurant for the cost of their room and board.

  • Children from ages 3-10. A children's rate will apply.

  • Children over age 10. They will be considered as adults to all effects.

Passport, visas and documentation  up
All customers without exception (including children) must have their personal and family documentation in order. This may be a passport or a national identity card, according to the laws of the countries they are visiting. Bitravel refuses all responsibility in cases where a customer is denied a visa by an authority due to a circumstance particular to the customer; or is denied entrance into the country for not having the required documents, for having defective documents, or for not being a carrier of the required documents. Any costs that are incurred by this type of circumstance are the responsibility of the customer.

Accommodation  up
The quality and content of the services provided by the lodging will be determined by the official tourist category assigned in Spain and France.

When making a reservation the client is completely and exclusively responsible for declaring the correct number of people that will occupy the lodgings, without omitting any children, whatever their age. Be advised that lodging management can legally deny admission to any people undeclared, and there is no compensation recourse for this cause.

It is possible to be furnished with supplementary beds or cots. These should be requested by the clients before finalizing the contract, and unless expressly stated otherwise, will not be included in the published lodging price.

The customary time for the arrival and departure to hotels is in function of the first and last service that the customer will use. As a general rule, and unless expressly otherwise agreed to in the contract, rooms can be entered from 2:00 p.m. on the day of arrival, and should be vacated by noon on the day of departure. If the customer expects to arrive at the reserved lodging at a different time, in order to avoid problems and misunderstandings it is necessary to communicate the fact to Bitravel or directly to the lodging with as much time as possible.

The customer should also consult with Bitravel at the time of making the reservation the possibility of taking pets, since pets are not generally admitted in hotels.

Using Bitravel´s web site  up
The user's use of the services contained on the BITRAVEL web site implies the acceptance of the following general conditions:

  • The user declares that he or she is an adult (18 years or older) and has the necessary legal capacity to contract the tourist services offered on the BITRAVEL web site, and also declares that he or she understands completely the conditions outlined here for using this web site.

  • BITRAVEL is not responsible for the user's misuse of passwords when a registered client reserves or contracts tourist products on the BITRAVEL web page. It is the user's responsibility to properly protect the passwords that are provided for access as a registered client, preventing their improper use by third parties.

  • In order for the user to be able to contract the tourist services contained on BITRAVEL's web site, he or she must register as a client, effectively declaring that all the information supplied when registering is accurate, complete, and exact.

  • All contents, brand names, logos, drawings, software, etc. that appear on the BITRAVEL web site are protected by the intellectual and industrial property rights expressly reserved by BITRAVEL, or in its particular case by the persons and companies that appear as the authors and owners of these rights.

  • The user accepts that it is Spain's legislation that is applicable to the operation of this service and submits to the jurisdiction of Bilbao's Courts and Tribunals for the resolution of any discrepancies that arise in the interpretation or application of this clause. BITRAVEL reserves the right to perform any changes to the terms and conditions established that it considers appropriate. The registration of the user as a registered client of BITRAVEL implies the knowledge and explicit acceptance of the current general conditions.

Data protection  up
In compliance with the law on the privacy of personal data and according to the Organic Law 15/1999, the details of a personal nature provided during the completion of this form will form a part of a file owned by Basque Incoming Travel, S.A., with the number 2060100530

By sending these details, the user or customer gives their consent for them to form a part of this file, and to be used to send information of a commercial or informative nature.

In compliance with this law, Basque Incoming Travel, S.A. will not carry out any total or partial transfer of this data to any other company or organization, nor will they use it for any other purpose other than that which is described in the previous paragraph.

Particular conditions for car rental  up
The cost of a car rental includes:

  • Use and enjoyment of the car for the number of contracted days, with unlimited mileage.
  • Mandatory car insurance, civil responsibility supplemental insurance, and an unlimited warranty
  • 16% VAT
  • Airport taxes

On arriving to the rental car agency the customer will present a Bitravel reservation voucher and will also provide credit card information for subsequent payment for any additional charges incurred.

We understand additional charges to be for petrol consumption, penalty for late car return, fee for an additional driver, traffic or parking fines, car accessories, or any other charge not included in Bitravel's package.

Driver's licence: The renter must have a valid driver's licence, have held a licence for at least one year, and be at least 23 years old.

Car Delivery and pick up: The car must be returned during office hours. In the case of delivery outside of office hours a supplement must be paid.

Particular conditions for hiring a tour guide  up
Visits cannot be modified unless previously agreed by both parties.

Transportation, including that of the guide, will be at the expense of the buyer.

A day of a tour guide's service is understood to be 4 hours. A day can be contracted for a morning schedule (from 10:00 a.m. to 2:00 p.m.), or for an afternoon schedule (from 4:00 p.m. to 8:00 p.m.). Anything beyond this number of hours or outside of the mentioned time frames will be considered overtime.


Particular conditions for camping vehicles rental  up

  • Minimum 3-day rental
  • Minimum rental in high season: 14 days
  • The driver must be over 25 years old and be in possession of a minimum 2-year Driving Licence.
  • A deposit must be left on all rentals, against possible damage, by means of a credit card (Visa, American Express)
